Terms of Use

1. Acceptance of Terms

By creating an account, accessing, or using FAII.AI (the “Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

FAII provides an AI Visibility Optimization platform that includes brand monitoring, AI rank tracking, website analytics for bot tracking, and automated content generation. The Service is provided on a “software-as-a-service” (SaaS) basis.

3. User Accounts

  • Registration: You must provide accurate and complete information when creating an account. You are solely responsible for the activity that occurs on your account and for keeping your account password secure.
  • Eligibility: You must be at least 18 years old to use the Service.
  • Prohibited Use: You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction.

4. Subscriptions and Payments

  • Fees: Certain aspects of the Service may be provided for a fee. You agree to pay all fees associated with your selected subscription plan.
  • Cancellation: You may cancel your subscription at any time. Your cancellation will take effect at the end of the current paid term. There are no refunds for partial months or years unless required by law.
  • Changes to Pricing: We reserve the right to modify our pricing at any time, effective upon the next renewal cycle of your subscription.

5. Intellectual Property Rights

  • Our IP: The Service and its original content (excluding Content provided by you), features, and functionality are and will remain the exclusive property of FAII and its licensors.
  • Your Content: You retain ownership of any data, text, or prompts you submit to the Service (“User Content”).
  • Generated Content: Subject to your compliance with these Terms, FAII assigns to you all rights, title, and interest in and to the output generated by the AI features of the Service (“Output”) for your business use.

6. AI Disclaimer & No Guarantees

  • No Ranking Guarantees: FAII provides tools to assist with “Generative Engine Optimization” (GEO). However, we do not and cannot guarantee specific rankings, brand mentions, or visibility outcomes on third-party platforms like Google, ChatGPT, or Perplexity, as these systems are controlled by third parties.
  • AI Accuracy: The Service utilizes Artificial Intelligence to generate insights and content. AI is probabilistic and may produce “hallucinations” or inaccurate information. You are responsible for reviewing and verifying all Output before publishing or relying on it.

7. Restrictions

You agree not to:

  • Reverse engineer, decompile, or attempt to extract the source code of the software.
  • Use the Service to build a competing product or service.
  • Send automated queries to the Service (outside of our official API, if available).
  • Use the Service to generate content that is hateful, harassing, or illegal.

8. Limitation of Liability

In no event shall FAII, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorized access, use, or alteration of your transmissions or content.

9. Indemnification

You agree to defend, indemnify, and hold harmless FAII and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from your use of the Service or breach of these Terms.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of law provisions.
